A -17 YEAR old male juvenile denied the Lusaka magistrates court that he defiled a girl below the age of 16 years because he thought she was 17 years.
This was when the matter came up for plea before magistrate Nsunge Chanda.
It is alleged that the boy defiled a girl under the age of 16 in January on a date unknown.
The boy said he did not know that the girl was below 17 years old.
Magistrate Chanda: Do you go to school? Where?
Juvenile: Yes, at the University of Zambia (UNZA).
Magistrate Chanda: What are you studying?
Magistrate Chanda: Did you have sex with the girl?
Magistrate Chanda: Why did you have sex with her when she is not your wife?
Juvenile: I was caught in the action
Magistrate Chanda: Is she your girlfriend and when did you have sex with her?
Juvenile: Yes, she is my girlfriend. I had sex with her at my friend’s house.
Magistrate Chanda; “why are you talking like you are in a disco. Can you put your hands down”.
Magistrate Chanda: Did you use a condom.
Magistrate Chanda: Didn’t you know that any of you could be HIV positive?
Magistrate Chanda: You are 17 years and the way you are behaving, you will be desiring to sleep with girls everywhere you go.
Magistrate Chanda: Did you ask the girl her age.
Juvenile: No, I don’t ask her the age but I thought she was 17 years.
His sister said the boy is a student and lives with their mother on holidays.
The matter comes up on November 6 for trial.
