A 34-YEAR old taxi driver who stood charged with raping his niece has been brought back to court after the State amended the indictment to incest.
This was heard in a case in which Gershom Nawa of Choma’s Macha Road Township is now charged with incest.
Particulars of the offence are that Nawa on October 8 had carnal knowledge of his 20 year old niece when he knew she was his biological relative.
Earlier Nawa was arraigned for rape but Choma Principal Resident Magistrate Exnobert Zulu was of the view that he was wrongly charged.
The contention on the charge arose after the victim in her testimony never said she was forced to have sex, but instead narrated on how she willingly lied on the bed during the act.
Magistrate Zulu then ordered that State appropriately amend the indictment.
When the matter came up for plea of incest, Nawa could not take plea as the court handling the matter was unavailable.
Resident Magistrate Ethel Phiri then adjourned the matter to December 20 for Plea with a mention on December 17.
